The Court can only exercise its competence only when national courts do not have the will and / or capacity to judge international crimes (principle of complementarity). To date, the Court has opened an investigation into thirteen situations: Uganda (2004), Democratic Republic of Congo (2004), Sudan (2005), Central African Republic (2007), Kenya (2010), Libya (2011), Coast of Ivory (2011), Mali (2013), Central African Republic II (2014), Georgia (2016) and Burundi (2017), Bangladesh / Myanmar (2019) and Afghanistan (2020). Seven preliminary examinations are in progress: Colombia (2004), Guinea (2009), Palestine (2015), Philippines (2018), Venezuela I (2018), Venezuela II (2020), Bolivia (2020). Eight others are closed with or without suite. The first trial of the ICC, that of Thomas Lubanga, begins on January 26, 2009. On March 14, 2012, it is convicted of war crimes. He is then the first individual sentenced by the jurisdiction.
